Financial Regulation Courses - FAQ

Our courses cover key financial services legislation, beginning with MiFID II (Directive 2014/65/EU), MiFIR (Regulation (EU) No 600/2014), and the Cyprus Investment Services and Regulated Markets Law (L.87(I)/2017), which together govern the licensing, conduct, and supervision of Cyprus Investment Firms (CIFs) and related activities.

We address the regulation of collective investment schemes under the AIFMD (Directive 2011/61/EU), and the UCITS Directive (2009/65/EC), as transposed in Cyprus by the law on alternative investment funds (AIF Law): L. 124(I)/2018, and the law on Undertakings for Collective Investments in Transferable Securities (UCITS Law): L. 78(I)/2012.

In relation to anti-money laundering, we cover the Cyprus AML Law (L.188(I)/2007, as amended), as it complies with the 4 th, 5 th, and 6 th AML Directives, and integrate new obligations under the EU AML Regulation (Regulation (EU) 2024/1624) and the AMLA Regulation (Regulation (EU) 2024/1620), which introduce consolidated supervision at EU-level.

The law of insurance regulation is studied within the framework of the Solvency II Directive (2009/138/EC) and the national implementation thereof in the Form of the Cyprus Insurance and Reinsurance Services Law (L.38(I)/2016).

On data protection, we address Regulation (EU) 2016/679 (GDPR) in its application to financial services with a particular focus on client data handling as a matter of KYC, and AML compliance.

 

Lastly, we document the regulatory treatment of crypto-assets in the Markets in Crypto-Assets Regulation (MiCA, Regulation (EU) 2023/1114) and how it will be embedded in the Cyprus supervisory regime of crypto-asset service providers, applying fully in 20242025.

  • Cyprus Securities and Exchange Commission (CySEC):Regulates and oversees Cyprus Investment Firms (CIFs), UCITS,Alternative Investment Funds (AIFs), fund managers and data reporting service providers in line with MiFID II, AIFMD, UCITS and national laws.
  • Cyprus Bar Association (Cyprus Bar Association (CyBar): Supervises and controls the lawyers, law firms and their delivery of Administrative Services as referred to in the Administrative Services Providers Law (L.196(I)/2012), and the AML Law.
  • Institute of Certified Public Accountants of Cyprus (ICPAC): It is the competent authority to regulate and supervise statutory auditors and audit firms under the Auditors Law of 2017 (L.53(I)/2017) and it also overlooks Administrative Service providing accounting professionals under the AML legislation.
  • Insurance Companies Control Service (ICCS): Insurance and reinsurance undertakings In the light of the Solvency II Directive, the regulation and supervision of insurance and reinsurance undertakings in Cyprus is provided by the Insurance and Reinsurance Services Law (L.38(I)/2016).

The law of Cyprus concerning the financial services is primarily composed of the directives and regulations of the European Union that are transposed into national law or directly applicable. The main framework consists of:

  • The Investment Services and Activities and Regulated Markets Law of 2017 (Law 87(I)/2017)– transposes MiFID II (Directive 2014/65/EU) and aligns with MiFIR (Regulation (EU) No 600/2014) for the regulation of Cyprus Investment Firms (CIFs);
  • The Alternative Investment Funds Law of 2018 (Law 124(I)/2018)– governs the authorisation, operation and supervision of Alternative Investment Funds (AIFs) and their managers, in line with the AIFMD;
  • The UCITS Law of 2012 (Law 78(I)/2012)– transposes Directive 2009/65/EC for the regulation of Undertakings for Collective Investment in Transferable Securities and UCITS Management Companies;
  • The Insurance and Reinsurance Services and Other Related Issues Law of 2016 (Law 38(I)/2016)– transposes the Solvency II Directive (2009/138/EC) and governs insurance and reinsurance undertakings;
  • The Prevention and Suppression of Money Laundering and Terrorist Financing Law of 2007 (Law 188(I)/2007), as amended– Cyprus’s principal AML legislation, incorporating the 4th, 5th, and 6th AML Directives, applicable across all financial and certain non-financial entities.

From 2026 onward, Regulation (EU) 2024/1624 (EU AML Regulation) and Regulation (EU) 2024/1620 (AMLA Regulation) will introduce directly applicable AML/CFT rules and a new supervisory structure at EU level.

Regulatory supervision in Cyprus is conducted by competent authorities based on the type of entity:

  • CySEC: for investment firms, collective investment funds, and asset managers;
  • Central Bank of Cyprus: for credit, payment, and electronic money institutions;
  • Insurance Companies Control Service (ICCS): for insurance and reinsurance companies;
  • Cyprus Bar Association (CyBar)and ICPAC: for lawyers and accountants providing administrative services.

Yes. Financial institutions in Cyprus must be authorised and regulated by the relevant competent authority, in accordance with national and EU law. Regulation is essential to ensure financial stability, protect consumers and investors from fraud and misconduct, prevent systemic risk, and combat financial crime, including money laundering. It also safeguards the integrity, solvency, and fair operation of the financial system. Operating without proper authorisation constitutes a criminal offence.
